Scope and business services

These terms concern the public website at nexionlabs.com, operated by NexionLabs Inc. They explain permission to use the website and its content.

Business services, APIs and customer accounts are governed by the relevant customer agreement. These website terms do not govern the Lognium mobile application. If these terms conflict with a customer agreement about services purchased under it, the customer agreement controls.

Permitted website use

You may browse the website and use its content for legitimate personal or internal business evaluation. You may share links and retain reasonable copies for that purpose with ownership notices intact. Software, SDKs and sample code remain subject to any separate licence supplied with them.

Do not use the website unlawfully, interfere with its operation, introduce malicious code, impersonate others or attempt unauthorized access to accounts, systems or information. This does not prohibit activity we authorize under a separate written agreement or rights applicable law does not permit us to restrict.

We retain ownership of our content and branding, and third parties retain rights in their materials. Permission to evaluate the website does not transfer ownership or permit presenting our branding as your own.

Enquiries and feedback

Only submit information you are entitled to share. Do not send identity documents, credentials or unnecessary sensitive information through the public contact form. Our privacy notice explains personal-information handling.

Any applicable confidentiality agreement governs information shared under it. If you voluntarily send non-confidential suggestions about the website, you allow us to use them to improve it without payment. You retain ownership of your ideas. This permission does not cover confidential information, personal information, customer data or feedback governed by a separate agreement.

Product information and external links

Website descriptions explain our services. Specific scope, availability, pricing, service levels and implementation obligations are those agreed in the relevant customer agreement. Website information does not replace advice about your own legal obligations.

External sites are controlled by their operators and have their own terms. A link does not itself endorse all of an operator's content or practices.

Website availability

We may update the public website and correct its content. We do not promise that each page will always be available or error-free. To the extent permitted by applicable law, public website content is provided as available without warranties of accuracy, completeness or fitness for a particular purpose. This does not reduce express commitments in a customer agreement or warranties that cannot lawfully be excluded.

Responsibility

To the extent permitted by applicable law, NexionLabs is not responsible for indirect or consequential losses arising solely from use of the public website. This website provision does not limit liability under a separate customer agreement.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, gross negligence, death or personal injury caused by negligence, or any other liability or statutory right that cannot lawfully be excluded or limited. In particular, these terms do not waive applicable data-protection rights.

Changes and access

We may restrict public website access to address unlawful use, security risks or interference with its operation. Customer-account suspension and termination follow the relevant customer agreement.

We show when these terms are updated and provide any additional notice required by applicable law. Changes to contracted services follow the relevant customer agreement. A failure to enforce a provision is not a waiver; if a provision is unenforceable, the remaining provisions continue to the extent permitted by law.

Governing law and contact

Delaware law governs these website terms, excluding its conflict-of-laws rules, except where mandatory applicable law provides otherwise. Disputes concerning these terms must be brought in the state or federal courts located in Delaware that have jurisdiction, unless mandatory applicable law entitles you to bring a claim elsewhere.

Nothing in these terms limits non-waivable consumer or data-protection rights or your right to contact a competent regulator. These terms do not require arbitration. Disputes under a separate customer agreement follow that agreement.
